Privacy policy

Transparent Capital LLC (“Transparent,” “we,” “us”) respects your privacy. This policy explains what we collect when you visit transparentcap.com, submit a file, or talk to us; how we use it; and — the part that matters in this business — exactly who gets to see it.

1.What we collect

Information you give us directly:

  • Your email address, to create your account. We do not use passwords — signing in sends a one-time code to that address.
  • The five questions only you can answer: how much you need, what it is for, when you need it, whether you can sign a personal guarantee, and anything a lender should hear from you first.
  • Financial documents you upload — tax returns, profit and loss statements, balance sheets, debt schedules, bank statements, agings and personal financial statements.
  • Business and owner details read from those documents, such as legal entity name, EIN, formation state and address. We read these off your files so you do not retype them; you can correct or clear any of them.
  • What you approve — the teaser you sign off, and each lender you approve by name.

We also collect limited technical information automatically: IP address, browser and device type, referring URL and pages visited.

2.How we use it

  • Underwrite your file, build the memo and teaser, and identify lenders whose credit box fits.
  • Run the placement — approach lenders you approve, compare indications, and negotiate terms.
  • Communicate with you about your file, what is missing, offers and status.
  • Meet legal, tax and fraud-prevention obligations.
  • Measure and improve the website and our marketing.

3.Who sees your file

This is the section worth reading. We are a placement agent: the point of the service is that lenders see your file. How much they see, and when, is controlled by you.

  • Nothing leaves without your approval. No lender receives anything until you have approved the teaser and approved that lender by name.
  • The market first sees a redacted teaser. Your business goes out under a codename, described by region rather than address, with identifying detail removed.
  • The full package follows an NDA, and only to lenders you approved.
  • Service providers who host and run the product — cloud hosting, database and document storage, email delivery, calendar scheduling and analytics — under contract and only to provide those services.
  • Authorities, where required by law, subpoena or court order.

We do not sell your personal information, and we do not trade or rent your data to third parties for their own marketing.

4.Cookies, analytics and advertising

We use a small number of cookies and similar technologies to keep you signed in, to measure how the site is used, and to attribute marketing campaigns. Depending on the campaign, these may include Vercel Analytics, Google Analytics, Google Ads and Meta advertising tools. Session cookies used for sign-in are strictly necessary — the portal cannot work without them. You can block or delete cookies in your browser, though some features will stop working.

5.Email, calls and texts

We email you about your file. If you give us your phone number and agree to it, we may also call or text you about your file — message and data rates may apply, message frequency varies, and consent is not a condition of any financing. Reply STOP to any text to stop receiving them, or HELP for help. You can ask us to stop contacting you by any channel at any time by emailing carmine@transparentcap.com, and we keep a record of what you agreed to and everything we have sent you.

6.How long we keep it

We keep file data for as long as needed to run and service the transaction, resolve disputes and meet legal and tax obligations — typically no less than seven years after the last interaction. You can ask us to delete earlier; see section 8.

7.Security

Documents are encrypted in transit and at rest, held in per-account storage, and access is restricted at the database level so one account cannot read another’s file. No system is perfectly secure. If you believe your information has been compromised, email carmine@transparentcap.com immediately.

8.Your rights

Depending on where you live, you may have the right to access, correct, delete, or restrict processing of your personal information, to receive a copy of it, and to opt out of certain sharing. To exercise any of these, email carmine@transparentcap.com and we will respond within the time the law allows.

California residents have additional rights under the CCPA/CPRA, including the right to know the categories of personal information we collect and disclose and the right not to be discriminated against for exercising them. We do not sell or share personal information as those terms are defined by the CCPA.

9.Children

The service is for business owners and is not directed at anyone under 18. We do not knowingly collect information from children.

10.Changes

We may update this policy as our practices or the law change. Material changes are posted here with a new effective date.
